Terms of Service

1. Who we are

"EnoSend", "we", "us" and "our" refer to the company operating the EnoSend platform. "You" refers to the individual or organisation that holds an EnoSend account.

2. The service

EnoSend provides REST APIs and dashboards for sending and receiving messages on third-party messaging networks, primarily WhatsApp. We are a software platform — not a telecommunications carrier and not affiliated with, endorsed by, or operated on behalf of WhatsApp LLC or Meta Platforms Inc.

3. Acceptable use

You agree to use EnoSend in line with our Acceptable Use Policy. In short: no spam, no unsolicited bulk messaging, no harassment, no illegal content, and you must respect the rules of every messaging network you reach through us.

4. Third-party network terms

You are solely responsible for your use of WhatsApp and any other third-party network reached through EnoSend. Each network — WhatsApp included — has its own terms of service and acceptable use rules. By using EnoSend you accept that:

  • WhatsApp may block, restrict, throttle or ban any number connected through our platform at its sole discretion;
  • WhatsApp's decisions are outside our control and we cannot guarantee deliverability, uptime, or appeal outcomes;
  • If a connected number is blocked, we may have no means of restoring it — that is a matter between you and WhatsApp;
  • We do not accept liability for blocks, bans, message rejections, account warnings or any downstream consequences imposed by a third-party network.

5. Billing

Plans bill monthly (or annually where offered) in advance. Top-ups, session fees and Partner volume charges are debited from your wallet as they accrue. Charges are non-refundable except where required by law or explicitly stated in our Refund Policy. You may cancel any subscription at any time — access continues to the end of the paid period.

6. Account security

You are responsible for keeping your password, API keys and signing secrets confidential. Enable two-factor authentication. We will never ask for your password by email or chat. If you suspect compromise, rotate your keys and email [email protected] immediately.

7. Suspension & termination

We may suspend or terminate accounts that breach these terms, our AUP, applicable law, or that pose a credible risk to the platform or its users. We will notify you by email except where prevented by law or urgent risk. On termination, fees already paid are non-refundable unless required by law.

8. Disclaimer & limitation of liability

EnoSend is provided "as is" and "as available". To the maximum extent permitted by law, EnoSend disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Our total liability for any claim is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary or punitive damages — including lost profits, lost data or business interruption — even if advised of the possibility.

9. Changes

We may update these terms. We will notify you of material changes by email or in-app at least 14 days before they take effect. Continued use after that date constitutes acceptance.

10. Governing law

These terms are governed by the laws of Ghana. Disputes are subject to the exclusive jurisdiction of the courts of Accra, Ghana, except where local consumer law gives you a non-waivable right to a different venue.
